Please read these terms carefully before using our tire recycling and disposal services.

Welcome to Tire Recycling Services ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our tire recycling, disposal, and related services ("Services") in Fort Myers, Florida, and surrounding areas of Southwest Florida.

By accessing our website, requesting a quote, scheduling service, or using any of our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Services.

1. Acceptance of Terms

By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. These Terms apply to all users, including without limitation: residential customers, commercial accounts, tire shops, auto repair centers, dealerships, fleet operators, property managers, and government agencies.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services following any changes constitutes acceptance of those changes. We encourage you to review these Terms periodically.

If you are using our Services on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Service Description

Tire Recycling Services provides tire collection, transportation, and recycling services in Fort Myers, Florida, and surrounding Southwest Florida counties. Our Services include but are not limited to:
Residential tire pickup and disposal
Commercial tire collection and recycling
Bulk tire removal for large quantities
Illegal tire dump site cleanup
Recurring scheduled service for businesses
Emergency tire removal services
Documentation and recycling certificates
We strive to recycle 100% of collected tires through certified processing facilities. However, we cannot guarantee that every tire will be recyclable, as some tires may be contaminated or damaged beyond processing capability.
Service availability, pricing, and specific offerings may vary based on location, quantity, tire type, and other factors. All services are subject to scheduling availability and weather conditions.

3. Eligibility & Account Requirements

To use our Services, you must:
Be at least 18 years of age or the age of legal majority in your jurisdiction
Have the legal capacity to enter into binding contracts
Provide accurate, current, and complete information when requesting service
Maintain the accuracy of your account information
Be located within our service area in Southwest Florida
For commercial accounts, additional requirements may apply, including business license verification, credit application, and signed service agreements for recurring service.
You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Pricing & Payment Terms

All prices are quoted in U.S. dollars and are subject to change without notice. Quotes are valid for 30 days unless otherwise specified. Final pricing may vary based on actual tire count, condition, accessibility, and other factors discovered at the time of service.

Payment Terms:

Residential customers: Payment is due at time of service unless prior arrangements are made
Commercial accounts: Net 30 terms available with approved credit; otherwise, payment due at service
We accept cash, checks, and major credit cards (Visa, MasterCard, American Express, Discover)
Returned checks subject to $35 fee plus applicable bank charges
Accounts past due 30 days subject to 1.5% monthly service charge

Volume Pricing: Discounts are available for quantities of 50+ tires. Custom quotes provided for projects exceeding 500 tires. Pricing does not include applicable taxes unless specified.

We reserve the right to require deposits for large projects or new commercial accounts. No refunds provided for services already rendered.

5. Scheduling & Cancellation Policy

Service appointments are scheduled based on availability. While we strive to accommodate preferred dates and times, all scheduling is subject to confirmation.

Cancellation Policy:

  • Cancellations made 24+ hours before scheduled service: No charge
  • Cancellations made less than 24 hours before service: 50% of quoted fee
  • No-shows or cancellations after our truck has been dispatched: Full quoted fee applies
  • Rescheduling requests follow same timeline as cancellations

Weather Delays: Service may be delayed or rescheduled due to severe weather conditions including hurricanes, tropical storms, flooding, or other events that create unsafe working conditions. We will make reasonable efforts to notify customers of weather-related delays.

Access Requirements: Customer must ensure safe and reasonable access to tires at scheduled time. Additional charges may apply if tires are not accessible as described, if hazardous conditions exist, or if additional labor is required beyond quoted scope.

6. Liability Limitations & Indemnification

Limitation of Liability: To the maximum extent permitted by law, Tire Recycling Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) our Services
  • Any conduct or content of any third party
  • Unauthorized access, use, or alteration of your transmissions or content
  • Events beyond our reasonable control, including weather, traffic, or equipment failure
Our total liability to you for all claims arising from or relating to these Terms or our Services shall not exceed the amount you paid us for the specific service giving rise to the claim.

Indemnification: You agree to indemnify, defend, and hold harmless Tire Recycling Services, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with:

  • Your access to or use of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any tires or materials you provide that violate these Terms

7. Prohibited Materials & Service Exclusions

We reserve the right to refuse service for any materials that do not meet our acceptance criteria. The following are prohibited and will not be accepted:
Tires containing hazardous materials, chemicals, or excessive contamination
Tires filled with concrete, dirt, or other solid materials
Tires from radioactive or biohazardous environments
Tires with attached batteries, fuel tanks, or other dangerous goods
Tires that have been burned or partially incinerated
Non-tire waste mixed with tire loads without prior arrangement
Tires in conditions that pose safety risks to our personnel
If prohibited materials are discovered after pickup, customer will be responsible for additional disposal fees and potential regulatory fines. We may terminate service immediately upon discovery of prohibited materials.

Site Conditions: Customer warrants that the service location is safe and legally accessible. We reserve the right to refuse service if site conditions present unreasonable safety hazards.

8. Privacy & Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our collection, use, and disclosure of information as described in our Privacy Policy.

We implement reasonable security measures to protect your personal information. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

For commercial accounts, we may collect business information including tax identification numbers, credit references, and banking information for billing purposes. This information is held securely and used only for account management.

9. Termination & Suspension

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

For commercial accounts with recurring service, either party may terminate with 30 days written notice. Outstanding balances remain due and payable upon termination.

10. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Informal Resolution: We encourage customers to contact us directly to resolve any disputes informally. Most concerns can be resolved quickly through direct communication.

Mediation: If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing litigation. Mediation shall be conducted in Lee County, Florida, with costs shared equally.

Litigation: If mediation fails, any legal action shall be brought exclusively in the state or federal courts located in Lee County, Florida. You consent to the personal jurisdiction of such courts.

Class Action Waiver: You agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Statute of Limitations: Any claim or cause of action arising from these Terms or our Services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

11. Changes to Terms & Contact Information

We reserve the right to modify or replace these Terms at any time. Material changes will be notified by posting to our website or by email to registered commercial accounts at least 30 days before taking effect.
Your continued use of our Services after any changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using our Services.

Entire Agreement: These Terms constitute the entire agreement between you and Tire Recycling Services regarding our Services and supersede all prior agreements, understandings, and representations.

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

By requesting service, scheduling pickup, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
